California Association of Private School Organizations is committed to respecting the privacy of its Users. This Privacy Policy applies to the California Association of Private School Organizations website ("CAPSO") www.capso.org and other sites and resources where this site is linked or referenced. This Privacy Policy describes the personal information CAPSO collects and how CAPSO may use, maintain and, in some cases, share that personal information. CAPSO COLLECTION OF PERSONAL INFORMATION
CAPSO collects Personally Identifiable Information that User gives to CAPSO voluntarily and that CAPSO collects from User's use of the Site, as more fully described below.

"Personally Identifiable Information" that CAPSO may collect includes information such as: first and last name; professional affiliation; job title; home or other physical address; personal or professional email address; telephone number; user name; payment information; and IP address.
CAPSO may use some of the Personally Identifiable Information it collects for research purposes, to develop CAPSO policies, and for reports related to CAPSO’S work.

CAPSO may also collect electronic information during User's use of the Site — including IP address, browser type, domain names, access times, geolocation, and referring sources — to enable CAPSO to analyze how visitors use the Site. This data enables CAPSO to become more familiar with people who visit the Site including how often they visit, their access times, etc. CAPSO will use this information to improve its services and obtain statistics regarding the use of the Site.

CAPSO may also use the information to which CAPSO has access to provide User with or solicit other information and to let User know of additional services that may be of interest to User. CAPSO will provide User with the opportunity to opt out of these communications.

SHARING PERSONALLY IDENTIFIABLE INFORMATION WITH THIRD PARTIES
CAPSO may share and disclose User's Personally Identifiable Information to third party service providers that CAPSO retains to perform functions on CAPSO’S behalf, such as payment processing, web hosting, data analyses, and communication services providers.

CAPSO may also share Personally Identifiable Information with affiliated CAPSO members and CAPSO business partners, for the purposes of conducting research projects, preparing reports, co-developing policy initiatives, or engaging in other work in furtherance of CAPSO’S mission. That information may be shared in an identifiable fashion or in a "de-identified" fashion, at CAPSO’S discretion, and as permitted by applicable law. Relatedly, Personally Identifiable Information once "de-identified" is not subject to this Privacy Policy and CAPSO may treat it as non-Personally Identifiable Information and use it without obligation to User, except as prohibited by applicable law.

CAPSO may also disclose User's Personally Identifiable Information, if required to do so by law, or when needed to protect an individual's personal safety, to protect the public, or to protect or further CAPSO’S rights, interests, or property. CAPSO will not sell User's information to anyone for commercial purposes.

CAPSO uses "cookies" on this Site. "Cookies" are small text files that are stored on a user's computer that facilitate a user's access to and use of a website. Cookies allow a website operator to track usage and behavior with respect to its sites.

CAPSO uses cookies to enhance the experience on our site by allowing members to maintain login status on CAPSO member website, to store user profile information such as user identification, school position and website role for page access permission and data retrieval authentication.

DO NOT TRACK NOTICE
Some web browsers (including Safari, Microsoft Edge, Firefox, and Chrome) incorporate a "Do Not Track" ("DNT") or similar feature that signals to websites that a visitor does not want to have their online activity and behavior tracked. If a website that responds to a certain DNT signal receives the DNT signal, the browser can block that website from collecting certain Personal Information about the browser's user. CAPSO does track visitor's use of the Site for internal website evaluation purposes. CAPSO DOES NOT track visitors over time and across third party websites. Therefore, CAPSO DOES NOT respond to DNT headers.

PROTECTING CHILDREN'S PRIVACY
CAPSO is concerned about the safety and privacy of children online. Therefore, CAPSO does not and will not knowingly contact or collect personal information from children under 13 years of age. If you are under the age of 13, please do not provide any Personal Information to CAPSO. CAPSO’S Site is not intended to solicit information of any kind from children under 13 years of age. If CAPSO is notified that CAPSO has received Personal Identifiable Information from an individual 13 or under, CAPSO will attempt to obtain parental consent or delete the information. CAPSO encourages parents to monitor their children's use of the internet and to help CAPSO protect their privacy by instructing them never to provide personal information on this Site or any other site without a parent's permission.

If any User wants to notify CAPSO of its receipt of information by or about any child under age 13, please contact CAPSO with the specific information.

SECURITY MEASURES
CAPSO has reasonable security measures in place to help protect against the loss, misuse or alteration of personal information within its possession. For example, only employees with a need to know certain information to perform a specific task are granted access to Personal Identifiable Information of users of the Site. In addition, the CAPSO servers that store sensitive information are kept in a secure environment.
However, no server, computer or communications network or system, or data transmission over the internet can be guaranteed to be 100% secure. As a result, while CAPSO strives to protect User information, CAPSO cannot ensure or warrant the security of any information User transmits to CAPSO or through the use of this Site. When User provides CAPSO information, User acknowledges and agrees that User provides such information and engages in such transmissions at User's own risk.

CREDIT CARD TRANSACTIONS
CAPSO provides links on the Site to pay for registration to CAPSO events. CAPSO does not process the credit card information. Instead, CAPSO has entered into an agreement with a third party payment processing service to collect, store, process, and transmit credit card data when User makes a payment. All online financial transactions are processed through a secure window hosted by CAPSO’S payment provider. All personally identifiable information transmitted back to CAPSO is also sent via SSL-secured connections. CAPSO does not store the credit card information on its own servers.

EMAILS
When User creates a profile, registers for an event, or signs up to receive email communications, User will be asked to supply an email address. Users are also subscribed to CAPSO emails based on information provided by the User's employer or their employer's membership with CAPSO. The emails User receives may include information relating to CAPSO’S mission, programs, resources, or content on CAPSO sites. User has the right to request: (1) more information about the categories and specific pieces of personal information CAPSO has collected and disclosed for a business purpose in the last 12 months; (2) the deletion of User's personal information; and (3) to "opt out" of receiving CAPSO online communications. Individual Users may opt out by following the unsubscribe directions on any of the emails or by logging into the member site to select the various groups from which the individual User wants and does not want to receive emails. User may also unsubscribe or request this information by contacting CAPSO with the specific request.
Please recognize that emails are not secure against interception. Therefore, please do not send CAPSO sensitive or personal information via email.

LINKS TO OTHER SITES
CAPSO provides links to other websites from the Site. Links to other websites do not imply an endorsement of the materials disseminated at those websites, nor does the existence of a link to another website imply that the organization or person publishing at that site endorses any of the materials on our platforms. CAPSO is not responsible for the privacy policies or the content on such sites. User should read the privacy policy of each website that User visits. This Privacy Policy applies only to information that CAPSO collects through its Site.

PUBLIC INFORMATION
There are member and public forums on the CAPSO Site, including job listings, event listings, member school information, and member contact information ("Public Information"). CAPSO allows users to add content that is public information. Some of these spaces are public, and the User Content may be accessed by many other users who visit the Site. For example, the users do not require a member log-in to view the job listings site. However, a member log-in is required to post a job listing.

CAPSO will try to let Users know what spaces are public within the Site and which portions are exclusive to members. User should take all of this into account when utilizing the Site, and providing information to CAPSO.

The Public Information is treated differently than the Personally Identifiable Information for the purposes of this Privacy Policy. When CAPSO uses the phrase public information, CAPSO means that the information may be publicly viewable on or off the Site without a member log-in, such as job listings, event listings, and member school information and publicly viewable information that is available to with a member log-in, such as other member contact information. User is acknowledging that CAPSO does not guarantee that such information will remain private; furthermore, User is acknowledging that CAPSO is not responsible for any disclosure of information that is both Public Information and Personally Identifiable Information and any legal ramifications pertaining thereto. Indeed, because CAPSO is not guaranteeing that such information will remain private, User should expect that anyone, including people off of the Site, will be able to see it.

The names of all institutions/organizations who are CAPSO members in good standing are listed on our website, along with links to their websites as provided by the CAPSO members.

CAPSO reserves the right to change, modify or update this Privacy Policy at any time. Any substantial changes in the way CAPSO use User's Personal Identifiable Information will be posted on this Site. User's continued use of this Site subsequent to CAPSO’S modification of the Privacy Policy shall constitute as User's acceptance.

General: The Site is intended for use by individuals and organizations wishing to learn about, or who are engaged in, CAPSO’S activities, including but not limited to, its membership programs, research, events, publications, or other activities engaged in furtherance of its mission.

All rights not expressly granted under these Terms are reserved by CAPSO. Accordingly, User may not use the Site in any manner that is not expressly and unambiguously authorized by the Terms. Any information User submits must be accurate and describe User and the organization on whose behalf User is creating such profile, if any. User acknowledges that User is responsible for the form, content, and accuracy of any information User provides to CAPSO and the Site. User understands and acknowledges that User has no ownership rights in User's account and that if User cancels User's account or User's account is terminated, all User's account information may be deleted from CAPSO’S Site.

Privacy: Information collected from User on the Site may be used in accordance with the terms of the Privacy Policy. CAPSO reserves the right to comply, in its sole discretion, with legal requirements to the extent compliance may require disclosure of such information. User understands and agrees that User is solely responsible for any liability arising from or related to any of User's User Content.

Rights in User Content: CAPSO claims no ownership or control over any User Content. User or a third party licensor, as appropriate, retains all patent, trademark and copyright interest to any User Content that User submits, posts or displays on or through the Site and User is responsible for protecting those rights, as appropriate. User grants CAPSO a worldwide, non-exclusive, irrevocable, royalty-free license (with rights of sublicense and assignment) to use, reproduce, modify, publish, translate, create derivative works from, distribute, transmit, perform, and display User's User Content. User permits any user to access, display, view, store, and reproduce such User Content for personal use. CAPSO reserves the right to refuse to accept, post, display or transmit any User Content in its sole discretion.

Indemnity: To the fullest extent permitted by law, User agrees to defend, indemnify and hold harmless CAPSO and its current and former directors, officers, employees, volunteers, and agents ("CAPSO Indemnities") from and against any claims, actions, lawsuits, damages, judgments, liabilities, causes of action, settlements, expenses (including attorney's fees and costs), or demands ("Claims"), arising out of or related to these Terms or User's use of the Site, including Claims for injury to property, injury or death to persons, and claims for infringement of intellectual property, that result from or arise out of User's or User's agent's intentional or negligent conduct. User shall not be obligated to indemnify, defend, or hold harmless a CAPSO Indemnity from Claims arising out of or related to a CAPSO Indemnitee's gross negligence or willful misconduct. This provision shall survive the termination or expiration of the Terms.

CAPSO’S Reservation of Rights: User agrees that CAPSO reserves the right to terminate access by User and other users to the Site without prior notice, without cause, and without explanation. CAPSO shall not be liable to User or any third party for any termination of User's access to the Site. CAPSO reserves the right to delete User's account and all of User's Information after a significant duration of inactivity. CAPSO may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of users of the Site. CAPSO shall be under no obligation to investigate potential violations and may terminate use without cause. CAPSO reserves the right to expel User, prevent further Site access, or take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for CAPSO, damage CAPSO’S brand or public image, or for any other reason.

LIMITATION OF LIABILITY. Law and Jurisdiction: Any disputes relating to the use of the Site shall be governed by the laws of California, without respect to any conflicts of laws rules. User expressly and irrevocably consents to the sole and exclusive jurisdiction and venue of the state and federal courts of Los Angeles, California to resolve any dispute between User and CAPSO relating to User's use of the Site. If User accesses the Site from a location outside of the United States does so at User's own risk and is responsible for compliance with the law of User's jurisdiction.

Severability; No Waiver: If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Modifications: CAPSO may in its sole discretion, add, modify, and delete any aspect, functionality, service, program or other feature of the Site. CAPSO also has the right in its sole discretion to modify these Terms from time to time, or at least every thirty days. It is User's responsibility to review these Terms & Conditions periodically. User's continued use of this Site subsequent to CAPSO’S modification of these Terms shall constitute as User's acceptance.
